Terms of Use
Terms for using the closed vehicle catalogue at germankos.de. These are not conditions of sale – the contract of sale is concluded separately.
1. Scope and operator
These terms govern use of the vehicle catalogue at germankos.de, operated by bitte in legal.json ausfüllen: unternehmen.firma, bitte in legal.json ausfüllen: unternehmen.strasse, bitte in legal.json ausfüllen: unternehmen.plz bitte in legal.json ausfüllen: unternehmen.ort (“the operator”). Full details in the imprint.
2. Trade use only
The catalogue is addressed exclusively to traders within the meaning of § 14 of the German Civil Code, to legal persons under public law and to special funds under public law. It is not offered to consumers within the meaning of § 13 of the German Civil Code. By using it you confirm that you are acting in the course of your trade, business or profession.
3. Access
- Access is granted through a personal access code issued to named recipients.
- The code is not transferable and must not be passed on to third parties – not even within affiliated companies, unless expressly agreed.
- The operator may block any access at any time and without giving reasons, in particular where these terms are breached.
- You must inform the operator without delay if you suspect that an access code has become known to unauthorised persons.
4. Confidentiality
The stock, the prices, the residual-value figures and all other details in the catalogue are confidential. You may use them solely to assess a purchase of your own. Publication, disclosure to third parties or use in your own sales listings requires the operator's prior written consent. This applies equally to screenshots and to data produced via the CSV export function.
4a. Exported data
You are responsible for any data you take out of the closed area via the CSV export or the copy function. You must protect it against unauthorised access within your own organisation, use it only for the purpose named in section 4, and delete it once that purpose has ceased. In so far as exported data contains personal data, you become an independent controller within the meaning of Art. 4 (7) GDPR.
5. Not a binding offer
The presentation of vehicles in the catalogue is not a binding offer within the meaning of § 145 of the German Civil Code, but a non-binding invitation to make an offer. A contract of sale is formed only upon separate written confirmation by the operator. Prior sale excepted.
6. Vehicle details
Vehicle data is taken from the operator's stock and buy-back lists and reproduced to the best of its knowledge. Errors excepted. In particular:
- Details of repaired prior damage reflect the repair costs documented in those lists and are no substitute for your own inspection.
- The residual percentage is a calculated figure (gross price divided by the gross list price) and not a valuation.
- Vehicle images are schematic illustrations generated from body type and paint colour. They do not show the individual vehicle and are not a statement of its condition. Where genuine photographs are held, this is indicated by the label “Photo”.
- The condition is determined by inspection or by a separate contractual agreement on quality.
7. Prices
All prices are net, plus statutory VAT at the applicable rate. The gross figures shown are for information and are calculated at 19 % VAT; the tax actually due depends on the place of supply and the purchaser's seat and is stated in the offer. Prices marked “incl. delivery” contain a delivery flat rate; “collection” means collection at the stated location.
8. Availability
The operator does not warrant any particular availability of the catalogue. Maintenance, security and capacity may cause interruptions. The operator may change, extend or discontinue the catalogue at any time.
9. Liability
The operator is liable without limitation for intent and gross negligence and for damage arising from injury to life, body or health. In cases of ordinary negligence the operator is liable only for breach of a material contractual obligation, and then limited to the foreseeable damage typical of such contracts. Liability is otherwise excluded. No liability is accepted for the accuracy and completeness of the catalogue details, to the extent permitted by law.
10. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a merchant, a legal person under public law or a special fund under public law, the place of jurisdiction is the operator's registered office. Should individual provisions be invalid, the validity of the remainder is unaffected.
